City Utilities Terms & Conditions

  1. Rules, Regulations, and Policies: You agree to be bound by all rules, regulations, rates, and policies adopted by the Board of Public Utilities of Springfield, Missouri, pertaining to your utility service.
  2. Electronic Signature: You agree to conduct transactions regarding your utility service by electronic means. You may also conduct transactions by other means, such as in person or by telephone. Your use of this Web site constitutes an electronic signature within the meaning of the Uniform Electronic Transactions Act, Sections 432.200 through 432.295, Revised Statutes of Missouri, and all revisions and additions thereto. You must be 18 years old to conduct transactions with City Utilities.
  3. Disclaimer and Limitation of Liability: THIS WEB SITE IS PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND. CITY UTILITIES SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM THE USE OF THIS WEB SITE. IN NO EVENT SHALL CITY UTILITIES BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL CITY UTILITIES’ DAMAGES EXCEED $1,000.
  4. Privacy: City Utilities respects the privacy of its customers. It treats names and addresses of residential customers as confidential. This information will not be released to the general public without residential customer consent. Names and addresses of commercial/industrial accounts are considered public information and will be released pursuant to a proper Sunshine Law Request.
City Utilities is subject to Chapter 610 of the Revised Statutes of Missouri (“Sunshine Law”). City Utilities may disclose any information that it is required to disclose by the Sunshine Law or any other applicable law.
City Utilities cooperates with law enforcement and other governmental agencies to enforce and comply with the law. It may disclose certain customer identifying information (e.g. name, address, former address, employer, former employer, birth year) to these agencies. Pursuant to Springfield City Code 110-2, City Utilities may release utility consumption facts and information about specific premises that are served by City Utilities to any person interested in occupancy of the premises. Other consumer information may be disclosed in response to subpoenas or other court orders. City Utilities’ Web site does use cookies and does not automatically collect any information regarding your email or domain address.
  5. Copyright: The contents and design of this Web site are owned by City Utilities and/or its vendors and are protected by the copyrights and trademarks of their respective owners. Except for your private, noncommercial use, you may not copy, use, or distribute the contents or design of this Web site. You must retain all copyright and trademark notices on all copies.
  6. Links: City Utilities shall not be liable for any third party Web sites that are linked to or from this Web site. City Utilities does not endorse or approve any such third party Web sites.
  7. Security: City Utilities has implemented security procedures to protect your account information. However, all Web sites are susceptible to unauthorized use. As a result, City Utilities cannot guarantee the security of any information you transmit using this Web site. You are responsible for keeping your passwords confidential.
  8. Changes in Terms: City Utilities may change the terms of this Web site at any time. You agree to these changes once they have been posted on this Web site.
  9. Governing Law: The use of this Web site and the provision of utility service to you are governed by Missouri law. The venue for all litigation arising from the use of this Web site or the provision of utility service to you shall be the state or federal courts of Greene County, Missouri.

Policy Introduction

This Acceptable Use Policy is part of SpringNet’s effort to provide reliable, high quality service to our customers while at the same time protect the privacy and security of our customers. We want to encourage responsible use of SpringNet’s resources and comply with applicable laws.

This Policy describes the types of uses of the SpringNet network which oppose our objectives and are therefore, prohibited. To achieve these objectives, SpringNet may at its sole discretion, determine whether a use of the SpringNet net network is a violation of this Policy. It is not SpringNet’s intent to monitor, control, or censor communications on the SpringNet network, however, when we become aware of a violation of this Policy, we may take such action as we deem appropriate to address the violation, as referenced below.

This Policy applies to all customers of SpringNet’s IP services, and to all other users of the SpringNet network. This Policy supplements, but does not supersede, the contracts that customers have with SpringNet; if such a contract restricts a use of the SpringNet network that is not addressed in this Policy, the contract will govern with respect to such use.

Nothing contained in this Policy shall create a duty for City Utilities to prevent or discover violations of this Policy by customers or third parties. City Utilities shall have no liability whatsoever for damages resulting from violations of this Policy by customers or third parties.

Prohibited Uses

Uses of the SpringNet network described below are prohibited under this Policy. These descriptions should be used as guidelines and are not intended to be exhaustive.

Illegal/Criminal Activity

The SpringNet network may not be used in connection with criminal or civil violations of state, federal, or international laws, regulations, or other government requirements. Such violations include theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery; theft or misappropriation of funds, credit cards, or personal information; and threats of physical harm or harassment.

Security Violations

The SpringNet network may not be used in connection with attempts ­ whether or not successful – to violate the security of a network, service, or other system. Examples of prohibited activities include hacking, cracking into, monitoring, or using systems without authorization; scanning ports; conducting denial of service attacks; and distributing viruses or other harmful software.
SpringNet customers are responsible for maintaining the basic security of their systems to prevent their use by others in a manner that violates this Policy. Examples include improperly securing a mail server so that it may be used by others to distribute spam, and improperly securing an FTP server so that it may be used by others to illegally distribute licensed software. Customers are expected to maintain appropriate software patch levels on servers to prevent their use as origin points for DDOS attacks, virus or worm distribution or other malevolent acts. Customers are responsible for taking immediate corrective actions on vulnerable or exploited systems to prevent continued abuse.

Threats

The SpringNet network may not be used to transmit materials of a threatening nature, including threats of death or physical harm, harassment, libel, and defamation.

Offensive Materials

The SpringNet network may not be used for the distribution of offensive materials, including obscene, pornographic, indecent, and hateful materials. Spam Spam is an unacceptable use of the SpringNet network. Spam includes any of the following activities:

  • Sending any unsolicited email that could be expected in SpringNet’s discretion, to provoke complaints.
  • Collecting the responses from unsolicited email.
  • Sending email with charity requests, petitions for signatures, or any chain mail related materials.
  • Sending unsolicited email without identifying in the email a clear and easy means to be excluded from receiving additional email from the originator of the email.
  • Not acting on a request to be excluded from mailings.
  • Sending email that does not accurately identify the sender, the sender’s return address, and the email address of origin.
  • Posting a single message, or messages similar in content, to more than five online forums or newsgroups.
  • Posting messages to online forums or newsgroups that violate the rules of the forums or newsgroups.
  • Using SpringNet facilities to violate another Internet Service Provider’s acceptable use policy and/or terms of service.

Indirect Access

A violation of this Policy by someone having only indirect access to the SpringNet network through a SpringNet customer’s connection will be considered a violation by that customer, whether or not it was done with the knowledge or consent of that customer. As an example, Down Stream Providers are responsible for the actions of their individual customers.

Public Communications Service Rate

As SpringNet has emerged as an important aspect of City Utilities’ primary business, it is appropriate that policies and rate schedules reflect the Utility’s commitment to these services. With the prospect of bringing on an outside partner to facilitate the growth of SpringNet, there is further reason to formalize our pricing structure in a public rate schedule.

In accordance with industry standards, the proposed rate schedule establishes that services offered by SpringNet will be negotiated on an “Individual Case Basis (ICB)”. Customers receiving service under the proposed rate schedule must enter into a contract with City Utilities, which includes a Master Service Agreement and Service Description. Each negotiated contract will define specific services offered and all monthly charges associated with each respective customer.
